Online Banking and Bill Pay Service Agreement and Disclosure

This Internet Banking and Bill Payment Agreement ("the Agreement") explains the terms and conditions governing the use of basic Internet Banking Services and Bill Payment Services offered by STAR Community Credit Union. All Internet Banking Services of any kind offered by STAR Community Credit Union (including, but not limited to funds transfers and bill payment services) will be referred to collectively as "Online Banking Services" in this Agreement. By using any of the Online Banking Services, you agree to abide by the terms and conditions of this Agreement as well as the Deposit Account Terms and Conditions. A copy of which may be accessed by calling your branch, or click on the disclosure section of this agreement. "I" refers to each person(s) who opens or those individuals authorized to use any account at STAR Community Credit Union and any person(s) who has been given a PIN or Password chosen by the member. The term "business day" means all days except Saturday, Sunday and all banking holidays.

This Agreement, as well as applicable Federal Regulatory disclosures and the Deposit Account Terms and Conditions of STAR Community Credit Union govern all Online Banking Services offered by STAR Community Credit Union. All applicable fee schedules published by STAR Community Credit Union from time to time will apply to the Online Banking Services. You are responsible for the payment of any fees incurred by you on any account, for any service, at any time. You agree to pay all such fees upon request of STAR Community Credit Union. Further, you agree to pay all telephone charges or fees incurred by you in accessing Online Banking Services. Online Banking Services requires you to have Internet access established.

By submitting this Form:
1) I agree that my use of the Online Banking Services will confirm that I have reviewed this Agreement and applicable disclosures, both of which STAR Community Credit Union may amend from time to time. My initial use of any Internet Banking Service in connection with my account(s) at STAR Community Credit Union constitutes my acceptance and agreement to be bound by all of the terms and conditions of this Agreement and of the Deposit Account Terms and Conditions.

2) I understand that my Password or PIN can be used to expend funds from my account and that this code must be safeguarded. I authorize STAR Community Credit Union and its agents to follow any instructions transmitted by use of this code, and I agree to be bound thereby. If accessing a business or non-commercial account, I certify that I am authorized to use the PIN or Password. STAR Community Credit Union is entitled to act upon instructions received through any Internet Banking Service under my PIN or Password without inquiring into the identity of the person using the PIN or Password. However, I agree that I will not, under any circumstances, disclose my PIN or Password to any person. I acknowledge that no employee of STAR Community Credit Union needs or should ever ask for my PIN or Password. I am liable for all transactions made or authorized using my PIN or Password. STAR Community Credit Union has no responsibility for establishing the identity of any person or determining the validity of any transaction received using my PIN or Password. If I provide my PIN or Password to anyone, I authorize any transactions carried out by that person. STAR Community Credit Union assumes all transactions authorized by my PIN or Password are legitimate. I hereby indemnify and release STAR Community Credit Union from any and all liability and agree not to make any claim against STAR Community Credit Union or bring any action against STAR Community Credit Union in honoring or allowing any actions or transactions where I have authorized the person performing the action or transaction to use my account or when I have provided my PIN or Password to that person.

3) I will notify STAR Community Credit Union at once if I believe another person has improperly obtained my PIN/Password or has carried out un-authorized transactions. At any time, I may ask STAR Community Credit Union to disable my PIN or Password and issue a new one to me.

4) If you have a business account you are liable for all transactions that occur on the account. The owner of the business account authorizes all transactions made by any other persons. The owner of the business account agrees to be liable for any other parties designated (by being given the pin or password) to conduct business on the account(s)

5) For multiple party accounts, each person on a multiple party account will be liable for all transactions that are made on that account. Each person on a multiple party account authorizes all transactions made by any other signer(s) on the account(s). Each owner(s) on a multiple party account(s) agrees to be liable for the actions of the other owner(s) on the account.
The limitations of liability set forth in this Agreement are subject to, and limited by any state or federal law to the contrary.

6) STAR Community Credit Union has the right to modify or terminate this Agreement or the Deposit Account Terms and Conditions at any time. When making changes, STAR Community Credit Union will comply with all legal notice requirements. Once this Agreement is terminated STAR Community Credit Union will not allow any additional transactions on the account, nor will additional Online Banking Services be permitted. If this Agreement is modified, my continued use of the Account will represent my acceptance of the changes.

7) In order to take advantage of other Internet Banking and Bill Payment Services offered, I understand that I must read and acknowledge this agreement and establish basic Online Banking Services with STAR Community Credit Union. All services later added are covered under this agreement and my acceptance authorizes STAR Community Credit Union to carry out transactions under any other Online Banking Services I decide to use or set-up at a future date, such as Bill Payment Services. By using any new service, I agree to be bound by the terms communicated to me in advance.

8) STAR Community Credit Union will not provide any receipt or documentation of transactions other than regular account statements.

What This Disclosure Covers

We, our and us, when used in this notice, mean S.T.A.R. Community Credit Union. This is our Privacy notice for our members. When we use the words "you" and "your" we mean the following types of members:

 

  • Our consumer members who have a continuing relationship by purchasing or holding financial products or services such as a(n):
  • Share account
  • Loan account
  • Credit card account
  • Self-directed Individual Retirement Account
  • All IRA accounts for which we act as custodian
  • Former members

 

We will tell you the sources of the information we collect about you. We will tell you what measures we take to secure that information.

We will tell you the sources of the information we share about you with other entities. We will explain what your rights are, and how you can exercise them. If you share an account relationship with someone else, such as a joint account holder or co-borrower, we suggest that you share this information with such persons to ensure that each of you is aware of our policy and you options.

 

We First Define Some Terms

Nonpublic personal information means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. Hereafter, we will use the term "information" to mean nonpublic personal information as defined in this section.

 

An affiliate is a company we own or control.

 

A nonaffiliated third party is a person we do not employ or a company that is not an affiliate of ours. This is also known as nonaffiliated third party or simply, an "other party"

 

Opt out means a choice you can make to prevent certain sharing of information. We will explain how you can exercise this choice.

 

Sources and Categories of Information We Collect

We collect information about you so that we can provide the products and services you request, develop new products and services, inform you about other products and services you may be interested in, and comply with legal and regulatory requirements. Examples of sources and types of information we collect include the following:

 

  • From your applications for our services or other communications you have with us, we obtain information such as your name, address, Social Security Number, assets, income, other debt, and financial transactions.
  • From our own records, we obtain information about your transactions and account experiences with us, such as account balances, payment history, parties to your transactions, and credit card use patterns.
  • From consumer reporting agencies, we obtain information about your financial history with third parties.
  • From third parties such as employers and other creditors, we verify information that you supply on your applications for our services.
  • We verify information for third parties involved in transactions on your Credit Union accounts, such as merchants calling to verify checks that you write.

 

Categories of Information We May Disclose About You

We may disclose any type of information we have about you to third parties to meet our reasonable business needs and to conduct your transactions.

 

Please be aware that S.T.A.R. Community Credit Union does not sell, share, trade or rent names or other information about our Members to third-party marketers.

 

Categories of Nonaffiliated Third Parties to Whom We Release Information to Conduct Our Business and as Required or Allowed by Law

We disclose information to non-affiliated third parties as necessary to conduct our business, to conduct your transactions, and as required or allowed by law. Examples include, but are not limited to:

 

  • Our state and federal regulators
  • Our attorneys, accountants and other advisors
  • Consumer reporting agencies
  • Third parties involved in your Credit Union transactions, such as merchants or other financial institutions
  • Third parties who make lawful information requests on your account, such as child support data matching programs

 

We will disclose any information we have about you to these parties as it is necessary to conduct our business, complete our transactions, or is required or permitted by law.

 

Other Nonaffiliated Third Parties to Whom We Release Information: Service Providers

We disclose information to third parties with which we have agreements to help us provide our products or services to you. We can disclose any information we have about you to these third parties, although we limit the information we supply to what is necessary for the third parties to fulfill their agreements with us. Before we disclose information to these third parties, they must agree in writing to keep your information confidential and use it only for purposes we authorize. Examples of such third parties include:

 

  • Companies with whom we have contracts to print and mail our Member statements
  • Companies with whom we have contracts to process Member credit card transactions

 

Disclosure of Information about Former Members and Customers

We have the same policy about disclosing information about former members as we do about current members.

 

Our Protection of the Security of Your Information

We restrict access to information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

 

Information on Public Records

You may be aware that businesses can obtain certain consumer information, such as that related to mortgage loans, which is a matter of public record and available to anyone from the County Recorder's Office. Unfortunately, this information is often used by companies to market their products and services directly to you. At times, they also make references to the Credit Union or its affiliates, which may imply that they obtained the information from us. The lenders' names, as well as certain details of the loans are included in the public records, and that is where they obtain their data.

 

Our Right to Change This Disclosure

This disclosure is effective July 1, 2006. We can change this disclosure by notifying you in writing. If a new disclosure will be subject to opt-out or opt-in rights, we will give you at least 45 days advance notice before the new disclosure goes into effect, and we will disclose the means by which you can opt-out of disclosure of nonpublic personal

 

Authorized Sharing-Joint Marketing

We may disclose the following information to other financial institutions with whom we have joint marketing agreements. Information you give us on an application or other forms, such as:

 

  • Name
  • Address
  • Social Security Number
  • Gender
  • Telephone Number

 

Information about your transactions with us, such as:

 

  • Account Number
  • Date account opened

 

We disclose the information listed above with other financial institutions with whom we have joint marketing agreements. As a California resident, you may have the right to opt-out of the disclosure of this information.

 

Types of Businesses

We may disclose information pursuant to joint marketing agreements to the following types of businesses. Financial services providers, such as:

 

  • Life insurers
  • Property and casualty insurers

 

Reasons for disclosing

We may disclose information about you to other financial institutions with whom we have joint marketing agreements to provide you with information about additional products and services.

 

Limitations on Disclosure

Here are the limitations we impose on the use of information disclosed on the use of information disclosed to other financial institutions with whom we have joint marketing agreements:

 

  • We only allow direct mail solicitations
  • We do not permit these companies to sell or share the information we provide to others.

 

Disclosure of Information Subject to Opt-Out or Opt-In Rights

 

Joint Marketing for California Residents

We have explained the kinds of information we may disclose to other financial institution with whom we have joint marketing agreements. If you are a California Resident, we will allow you to opt-out of the disclosure of this information. To do so, fill out the following form labeled "Important Privacy Choices for Consumers."

 

Your decision to block the disclosure of your information will apply to information collected from all products and services you receive from us.

 

If you have obtained one or more products or services jointly, an opt out instruction by one party is effective for all information we have collected about all joint parties. If one of you chooses to opt out, no information about any of the joint parties will be shared.

 

If you previously sent us an opt-out notice, then we will continue to apply the instruction to the information you asked us not to share. You do not need to return another opt out form.
